Kils municipality criticised for unlawful procurement of services

Kils municipality has been criticised by the Swedish Competition Authority for not publicly procuring certain technical consultancy services. Through its actions, the municipality has infringed the law on procurement.

Kils municipality purchased technical consultancy services for over SEK 900,000 without advertising a competitive procurement process. Such direct procurement is prohibited under the law on procurement.

In its decision on the issue, the Competition Authority has now levelled criticism at Kils municipality.

"We take this type of offence very seriously. Unlawful direct procurement is one of the priorities in our regulatory work," comments Dan Sjöblom, Director-General of the Competition Authority.

However, due to the one-year limitation period, the Competition Authority cannot take legal proceedings and demand that the municipality be ordered to pay a public procurement fine by the administrative court.
