Voluntary ex ante transparency

A contracting authority can publish a contract notice through ‘voluntary ex ante transparency’ if it intends to award a contract without prior publication or to award a contract by negotiated procedure without prior publication of a contract notice.

A notice of ex ante transparency must be published in a corresponding way as for normal contract notices. If the administrative court has not received an application for a review before the expiry of the ‘standstill period’, the contract awarded without prior publication may subsequently not be subject to review.
